Letters of Administration/Probate
When a loved one dies it may be necessary to make an application to the Supreme Court to obtain either Letters or Probate so that the administrator or executor can give effect to the Will, or otherwise distribute the deceased’s estate.
We can provide advice as to whether such an application is necessary, and if it is, we can prepare the necessary documentation on your behalf.
Enduring Powers of Attorney/Powers of Attorney and Guardianship
A Power of Attorney appoints someone to act on your behalf in your financial affairs – this may be helpful if you are travelling overseas, or remotely, and need to conduct business whilst you are away, or you are physically incapacitated.
A Power of Attorney is only useful whilst you have the mental capacity to make decisions for yourself.
If you wish to appoint someone to act on your behalf in your financial affairs if you lose your mental capacity, an Enduring Power of Attorney is more appropriate.
An Enduring Power of Guardianship appoints someone to make lifestyle and health decisions for you if you no longer have the mental capacity to make those decisions yourself.
