Worker’s Compensation
You may have a Worker’s Compensation claim if you suffer an injury at work. Pre-existing conditions aggravated by your employment, disease brought on by work, and accidents are all potentially compensable.
Compensation can be paid as weekly payments, or to cover medical expenses and, in some circumstances, can involve a lump sum payment.
Motor Vehicle Compensation
The compulsory third-party personal injury insurance scheme covers any motor vehicle licensed or registered in WA. Suppose you are injured in a motor vehicle accident in Western Australia. In that case, your claim is against the Insurance Commission for the negligence of the vehicle’s driver that caused injury. Payments can be made under the scheme to cover medical expenses, economic loss, and pain and suffering.
Criminal Injuries Compensation
The WA Government has a Criminal Injuries Compensation Scheme, which allows a victim of a crime to apply for compensation in some circumstances. If you are the victim of a crime and have suffered financial loss or physical injury, or you are the close relative of a person killed as a result of an offence, you may be eligible for compensation under the Criminal Injuries Compensation Act.
Negligence
If you are injured or suffer loss because of another person’s negligence or failure to act, you may have a claim against them. No statutory scheme covers negligence, so a claim must be filed in the Court against the negligent person if you wish to pursue damages against them.
Negligence can occur in the provision of services or in relation to property and, in some circumstances, can overlap the specific statutory schemes mentioned above.
