A Worker’s Compensation claim can arise when you are injured at work. Pre-existing conditions aggravated by work, disease bought on by work and accidents are all potentially compensable. Compensation can be paid as weekly payments, to cover medical expenses and in some circumstances can involve a lump sum payment. You may wish to take legal advice to ensure your entitlements are maximised.
Any motor vehicle licensed or registered in WA is covered under the compulsory third party personal injury insurance scheme. If you are injured as a result of a motor vehicle accident in Western Australia, your claim is against the Insurance Commission for the negligence of the driver of the vehicle that caused injury. Payments can be made under the scheme to cover medical expenses, economic loss and pain and suffering.
The WA Government has a Criminal Injuries Compensation Scheme which allows a victim of crime to apply for compensation in some circumstances as a result of an offence. If you are the victim of a crime and have suffered financial loss or physical injury, or you are the close relative of a person killed as a result of an offence, you may be eligible for compensation under the Criminal Injuries Compensation Act.
If you are injured or suffer loss as a result of another person’s act, where that person negligently did something, or negligently failed to do something, you may have a claim against them. There is no statutory scheme covering negligence, so a claim must be filed in the court against the negligent person if you wish to pursue damages against them. Negligence can occur anywhere in the provision of services, or in relation to property and in some circumstances can overlap the specific statutory schemes mentioned above.
